Overview
Your privacy is very important to us. This Privacy Policy represents our commitment to maintaining the privacy and security of your personal information. We reserve the right to change this policy at any time, which we’ll do through posting on the Surgicept® website or an email message sent directly to you.

Personal Information
Personal information (“PI”) means any information that directly and clearly identifies an Individual (such as, name) or can be used in combination with other information to reasonably identify an Individual (such as, gender or age). Sensitive personal information is a subset of PI that is more sensitive in nature than PI. It reveals race, religion, origin, political opinions, union membership, sexual preferences, sexual orientation, genetic data or biometric data.

Collection and Use of Information
If you subscribe to Surgicept® or visit surgicept.com, we collect personal information to provide you with an efficient, meaningful and customized experience.In order to make a purchase or subscribe to a Surgicept® Subscription, you must create an account and provide your name, shipping address, billing address, and credit card information. We use this information to process and fulfill your order and to notify you of your order status. All archived credit card information is maintained by a third party in a secure and safe environment.

As is true of most websites, we automatically gather certain information in order to improve the overall experience on our site and help with troubleshooting. Some of that information includes device type, IP address, time and date of visit, browser type, referring pages, session start/stop time, and time zone. We may use this information to fulfill your order, respond to customer service requests, administer your account, respond to questions or concerns, and improve our website and marketing efforts.

We collect your PI when you:

  • Visit our website;
  • Ask us to provide our products or services to you, and you give us your PI with your request;
  • Communicate with us by telephone, email, one of our websites or hard copy correspondence;
  • Reply to one of our promotions, request a product sample, enter a sweepstakes, or subscribe to our promotions or email.

If you fail to provide your PI to us when requested, we may not be able to perform all our legal and contractual obligations. We also collect your PI from third parties such as our distributors and marketing representatives.

Information Sharing with Third Parties
Surgicept® does not sell your PI to third parties for monetary payment.

We may transfer your PI to third parties where Surgicept® does not receive a monetary payment. For example:

  • When you request us do to so, or provide your consent to us to do so;
  • To Service Providers, such as payment processors, that process your PI for a Surgicept® business purpose under a written contract between Surgicept® and the Service Provider. 
  • To our distributor partners and marketing representatives to assist in their sales efforts.

Rights Regarding Your PI
When you contact Surgicept® to exercise any of the rights you have, we may request information from you to confirm your identity. If we cannot verify that the Individual making the request is you, we may deny the request.

There will be no charge to request and receive your PI. 

In some cases, Surgicept® may be prohibited by law, agreement or legitimate interest to fully comply with your request. When those situations arise, we will inform you of why we are unable to fulfill your request.

Security of Collected Information
We are committed to protecting the security of the PI we collect from you. Surgicept® uses reasonable physical, technical and administrative safeguards to help protect the information from destruction, loss and unauthorized or inappropriate access or use.

Third-Party Websites
Our website may contain links to third-party sites. When you click on a link to another site or location, you will leave our site where another entity may collect personal information from you. We have no control over and are not responsible for these other sites or any information they may collect from you.

Marketing Communications
We want to communicate with you about Surgicept® news and updates related to our products and services. You may choose to stop receiving our marketing emails by following the unsubscribe instructions included in these messages or by updating your communications preferences in your account profile.

California Residents
In addition to other rights already discussed in this Privacy Policy, if you are a California consumer, you may be entitled to certain rights under the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA defines PI very broadly. 

Under the CCPA, California residents have (a) the right to request access to the personal information collected in the previous 12 months; (b) the right to request deletion of personal information; and (c) the right to opt out of the “sale” of personal information. These rights are subject to certain exemptions and exceptions as well as certain steps we must take to verify your identity.

In addition, if a California consumer exercises his or her rights under the CCPA, we shall not discriminate against that consumer by denying him or her our goods or services, charging different prices or rates to similarly situated consumers, or providing a different level or quality of our goods or services.
